Explanation:
act of God, in law, an accident caused by the operation of extraordinary natural force. The effect of ordinary natural causes (e.g., that rain will leak through a defective roof) may be foreseen and avoided by the exercise of human care; failure to take the necessary precautions constitutes negligence, and the party injured in the accident may be entitled to damages. An act of God, however, is so extraordinary and devoid of human agency that reasonable care would not avoid the consequences; hence, the injured party has no right to damages. Accidents caused by tornadoes, perils of the sea, extraordinary floods, and severe ice storms are usually considered acts of God, but fires are not so considered unless they are caused by lightning.

The “typical” force majeure provision in any contract for any product or service usually looks something like this:

“Neither party shall be liable for any delay in, or failure of, its performance of any of its obligations under this Agreement if such delay or failure is caused by events beyond the reasonable control of the affected party, including but not limited to any acts of God, governmental embargoes, restrictions, quarantines, strikes, riots, wars or other military action, civil disorder, acts of terrorism, rebellions or revolutions, fires, floods, vandalism, sabotage or the acts of third parties.”

The lease also contained a force majeure clause, which provided that neither the landlord nor the tenant would be in default if its performance was delayed or prevented due to strikes, lockouts, inability to obtain labor or materials on the open market, war, riots, unusual weather conditions, acts of God, or other similar cause beyond its control. W systemie prawa cywilnego jest pełna możliwość korzystania ze zwalniania z odpowiedzialności w przypadku siły wyższej. W systemie prawa powszechnego niezbędna jest konkretna klauzula w umowie. Bez takiej klauzuli uznaje się jedynie tzw. akty boże, mające miejsce w obrocie morskim.

Nie moge się zgodzić z tłumaczeniem "acts of God" jako "siły wyższej".
"Akty boże",czy też bardziej po polsku "działania sił natury", stanowią jedną z kategorii przejawów "siły wyższej". Jak widać z powyższych linków jako siłę wyższą traktuje sie również "czynnik ludzki" w postaci wojen, strajków, nieprzewidzianych działań władzy państwowej itp. Z "aktami bożymi" nie ma zbyt wiele wspólnego, a siłą wyższą (przynajmniej w klauzulach umownych) jest.

Tłumaczenie "Acts of God" jako siły wyzszej nie jest więc tak do końca błędne, ale stanowi dość istotne zawężenie definicji siły wyższej, co nie powinno miec moim zdaniem miejsca. Podobny pogląd został juz zresztą (choć nieco bardziej enigmatycznie) wyrażony na ProZ. [Patrz link powyżej - opinia Anglisty]
