moim zdaniem 'the same' tu odnosi się do wspomnianych wcześniej w zdaniu: Konkursu, Nagród, Warunków

czyli druga część zdania imho będzie brzmiała: i/lub udziału w Konkursie, korzystania z Nagród oraz stosowania/spełnienia Warunków, za wyjątkiem odpowiedzialności, której nie można wyłączyć z mocy prawa.
co prawda w wersji ang. jest tylko słowo 'use', ale lepiej to chyba rozbudować, bo np z Konkursu 'korzystać' ciężko:)
