On appeal, the defendant’scounsel argued that this evidence did not meet the standards of the Frye test andtherefore should not be admissible in court. However, the court affirmed theoriginal ruling, stating that the Frye test did not apply in this case because the FBIagent’s linkage analysis was based upon his own knowledge and experience andnot scientific tests for which the Frye test would typically be applied. In theirwritings about investigations, FBI agents do often refer to the twofold classification we have studied. So in future cases, cross-examination may determinewhether "this category scheme was implicit" in their interpretation of their own experience.
