This form of profiling is consequently more common, being less open toprejudice or to being kept out of court because it addresses the “ultimate issue” ofguilt. In Delaware v. Pennell (1989) substantial physical and circumstantialevidence was available linking the defendant to two of a series of three murders.In this case, the trial court accepted testimony provided by an FBI agent that eachof the three murders in question had characteristic behavioral similarities thatsuggested they were the work of the same offender. On appeal, the defendant’scounsel argued that this evidence did not meet the standards of the Frye test andtherefore should not be admissible in court. However, the court affirmed theoriginal ruling, stating that the Frye test did not apply in this case because the FBIagent’s linkage analysis was based upon his own knowledge and experience andnot scientific tests for which the Frye test would typically be applied. In theirwritings about investigations, FBI agents do often refer to the twofold classification we have studied. So in future cases, cross-examination may determinewhether "this category scheme was implicit" in their interpretation of their own experience.

Asker: Wspomniana 'twofold classification' odnosi sie do podzialu na 'character profiling' oraz 'similarity profiling'. Dzieki za propozycje tlumaczenia tej frazy, brzmi b. sensownie. Lepoej nawet brzmi 'zawarta' niz 'ukryta' w tym kontekscie chyba.
