  -> Ok thanks Mark, you may be right up to a degree, but according to my source reference, the parties are not obliged to enforce the agreements. However, this point does not necessarily invalidate my translation of the term.

Explanation:
I agree with Mark´s suggestion "acordo mútuo" entre as partes. Even more, if we are talking about a Contract or Agreement, at the end of agreement where both sides set their signatures, I would think translating as follow: E por estarem justas e contratadas as partes, DDI e Representative, assinam o presente instrumento
