INCIDENT OF OWNERSHIP A term used in estate tax law to describe any interest in a life insurance policy, which if owned by a decedent insured, will cause the proceeds of that policy to be included in his estate for estate tax purposes. Example: Insured A gives an insurance policy on his life to his son, B, but retains the right to change the beneficiary payment options. A has retained an incident of ownership.
