O fideicomisso é um ato de disposição de vontade expressa em testamento, pelo qual uma pessoa pode deixar um bem imóvel para o sucessor do seu herdeiro. O herdeiro ou legatário que recebe em primeiro grau o imóvel denomina-se fiduciário, ficando ele com o encargo de transmitir a propriedade para aquele que será o proprietário final do bem, designado fideicomissário. O Código Civil de 2002, no seu art. 1.951, assim define o fideicomisso: “Pode o testador instituir herdeiros ou legatários, estabelecendo que, por ocasião de sua morte, a herança ou o legado se transmita ao fiduciário, resolvendo-se o direito deste, por sua morte, a certo tempo ou sob certa condição, em favor de outrem, que se qualifica de fideicomissário”.
