eIS O TRECHO, DO SITE CITADO:

É regra de hermenêutica jurídica que o benefício previdenciário deve ser regido pela norma vigente quando de sua perfectibilização. É a concretização do princípio tempus regit actum. 19. No caso do benefício intitulado pensão por morte, como o próprio nome já deixa deduzir, ele é devido ao conjunto de dependentes do segurado e será prestado em face da morte dele (art. 74, caput, da Lei nº 8.213/91). Portanto, esse tipo de benefício previdenciário somente se aperfeiçoa com a morte do instituidor.
