"- nulitatea procesului in prima instanta, ca urmare a nejudecarii cauzei de fond; judecata s-a facut in lipsa partilor (desi reclamantul solicitase un termen pentru efectuarea procedurii de citare), iar procurorul a pus concluzii numai cu privire la "exceptia de inadmisibilitate a exceptiilor de neconstitutionalitate invocate", iar nu pe fond;"

Fiind sisteme diferite, sigur că nu se referă la acelaşi lucru. Dar, dacă este să-i spunem cumva pe româneşte, nu ştiu cum altfel i-am putea spune. Dacă ne uităm la definiţiile de la http://www.google.ro/search?hl=ro&q=define: mistrial&btnG=Că... , despre asta este vorba, despre nulitatea procesului. Din definiţiile pe care le-am găsit, nulitatea nu este numai rezultatul lipsei unanimităţii juriului. Pot fi mai multe motive: "Reasons for mistrial include misconduct on the part of the jury, defense team or the court, or illness on the part of the judge, jury or defendant."
