We do understand that this subject is of considerable importance to OJSC ?Mosenergo? as the Customer. However, all references to the provisions of the General Contractor Agreement are irrelevant because they were applicable and executable at the time of initial bonds provision including the proformas of the aforementioned bonds as the attachment to the Agreement. The Advance payment bond was expired last year and the Customer returned and didn?t initiate the issue by the General Contractor the new Advance Payment bonds ## because there are no legal grounds for this. We would like to draw Your kind attention that the General Contractor (RUAP/CHAP) completed his obligation in the amount of the Advance payment indicated in the Attachments to the General Contractor Agreement.

Банковская гарантия на возврат банковского платежа (Гарантия предоплаты) истекла в прошлом году, Заказчик вернул ее и не предпринял меры для выдачи Генеральным Подрядчиком новых гарантий предоплаты, т.к. не было на это законных оснований.
