Legal Discovery

Background and Challenge

The facts, as related to Legal Discovery, speak for themselves:

Ninety-nine percent of all documents today are stored in electronic format.
E-discovery is the number one new litigation-related burden for general counsel at companies with annual revenue exceeding $100 million.
Electronic data is utilized in three out of every four lawsuits involving Fortune 500 companies.
90% of U.S. corporations are engaged in some kind of litigation.
The average company with revenue exceeding $1 billion dollars averages 147 simultaneous lawsuits.

Phases of Legal Discovery

*********
The Legal Discovery process is often defined as having several distinct phases:
*********

Data Acquisition and Litigation Hold Phase
In this phase parties are required to preserve documents that are relevant to a case based on the anticipation of litigation. This is often accomplished by legal council communicating to those that may have such documents to ensure that such documents are preserved. The terminology used to describe this is "litigation hold" .

The Kazeon Information Server scalability enables an organization to catalog and index hundreds of millions of documents scattered across enterprise networks, whether this information resides on storage, server, or desktop/laptop systems. This enables litigators to quickly identify documents that are relevant to a court case during the data acquisition phase. Once relevant documents are identified they can be grouped such that they are associated with a particular case. Relevant documents are preserved during

"Litigation Hold" by copying or moving documents to secure storage devices with retention dates to ensure that they are not altered or deleted.

Culling Phase
In this phase, also often called the pruning phase, electronic data not relevant to the case is eliminated.

The Information Server index and search facilities enable legal staff to quickly cull through millions of documents based on file attributes (owner, age, last time modified, etc) and content (keyword, pattern matching, etc). This combined with the Information Server' s ability to identify duplicate and near-duplicate documents dramatically reduces the number of documents that need to be manually reviewed.

Review and Collaboration Phase
In this phase, litigators collaborate and review relevant data. The Information Server' s powerful tagging capability enables the grouping of documents associated with a specific court case. This can be done manually or automatically so that files that meet a certain criteria (owner, keywords, etc) are grouped for the legal staff. Tagging also enables authorization control such that only the appropriate litigators have access to documents for a specific court case.

Summary
The Information Server dramatically reduces costs and ensures the preservation of documents during the data acquisition, culling, and “litigation hold” stages while providing added value during the review and collaboration phase.
