A person cannot generally disinherit his/her spouse under U.S. law. If the will leaves nothing to the spouse, the spouse gets 1/3 or 1/2 of probate property as a matter of law anyway, the amount depending on what state you're in. This is called "elect against the will." There may be other reasons to elect against the will as well.

I'm confused though - are you translating a prenuptial agreement? I would think they'd be contracting *not* to elect against the will, in which case my answer should be reversed.

Очень похоже на опечатку. Мне кажется, что смысл тот, что одна сторона может выбрать то, что ей более выгодно - наследовать по завещанию или дополнению к завещанию, составленному другой стороной (OF the other party, а не OR the other party) либо воспользоваться правами, которые предоставляет закон. В принципе, это стандартное положение прав наследования между супругами - воспользоваться правами по завещанию или to elect against the estate, т.е. получить минимальную законную долю супруга(супруги), даже если умерший супруг обделил выжившего в завещании.
