Explanation:
It means they will only choose ("elect") the minimum that the law guarantees, instead of what may be promised in a will.

A person cannot generally disinherit his/her spouse under U.S. law. If the will leaves nothing to the spouse, the spouse gets 1/3 or 1/2 of probate property as a matter of law anyway, the amount depending on what state you're in. This is called "elect against the will." There may be other reasons to elect against the will as well.

"A will provision may specifically disinherit any person or persons, including those persons who would technically be the natural objects of the testator's bounty. The only limitation on such disinheritance is that a surviving spouse usually has a right to elect a statutory share of the estate against what, if anything, is left for the surviving spouse in the will. In other words, a surviving spouse can only be disinherited to the extent he or she can elect against the will."

I'm confused though - are you translating a prenuptial agreement? I would think they'd be contracting *not* to elect against the will, in which case my answer should be reversed.

This might be better - The parties waive their:

It seems there is a similar concept in St. 1149 of the GKRF

agree  Katia Gygax: I vote for the latest update: it has to be reversed, the wealthier partner might be protecting his children or something else, brief it happens.

Explanation:
В принципе, это стандартное положение прав наследования между супругами - воспользоваться правами по завещанию или to elect against the estate, т.е.
