Обычно в соответствии с Руководством о назначении наказания и определении даты освобождения (Sentencing and Release Guidelines, см. пример здесь: http://www.sentencing.state.ut.us/Guidelines/Adult/2010 Adul... имеется ряд факторов, которые принимаются во внимание соответствующими комиссиями (в США это Board of Pardons and Parole) при определении срока пребывания конкретного заключенного в исправительном учреждении.
