Откуда ноги растут: Письменные показания обычно являются первым шагом, а показания в суде - вторым. В письменном показании свидетель как бы говорит: Я Иван Иванов _буду давать_ следующие показания в суде под присягой. Но реально этот смысл уже давно отпал, т.к. точно также составляются свидетельские показания тех свидетелей, которые в суде выступать не собираются (e.g. witness deposition).
