SCREENING FEE
Landlords carry out tenant background check before renting the property to a tenant. ***Tenant credit history checks*** reflect the credit worth of an aspiring tenant. Credit reports can be expensive, particularly if large number of applicants has to be screened. For this reason, many landlords request that the applicant pay for the credit check. The landlord should be sure which credit report is required, so that only the correct amount is charged from the applicants.
When a rental application is submitted, the landlord may charge the tenant an application screening fee. The amount that can be charged from the tenant by the landlord may be up to $37.57, and he/she may use this amount to cover the cost of getting information about the tenant, such as checking the personal references and obtaining a credit report from a Tenant screening service agency.
Before the application screening fee is paid, the tenant must enquire with the landlord about the details of the screening as to how long it will take the landlord to get a copy of the credit report, or whether the fee is refundable if the tenant finds another rental place before the credit report is obtained or if the procedure takes too long to complete, and also whether the landlord will accept a current copy of credit report if the tenant has one.
California law states legally that the application fee cannot be more than the landlord’s actual cost incurred, and can never be more than $37.57. A receipt should be given to the tenant by the landlord who lists his or her out-of-pocket expenses in obtaining and processing the information about the tenant. Any unused amount should be returned back to the tenant. If the tenant does not want to pay for the application screening fees, it is better that the tenant find another rental unit. Any payment the tenant pays including the application screening fee and any agreement regarding a refund should be in writing.
If the landlord knows that there is no vacancy and he/she cannot charge you an application screening fee. If in any of these situations the tenant gives an agreement in writing, the landlord can charge an application screening fee. Once the credit report is obtained, the landlord must give you a copy of the report if a request is made by the tenant. It`s always a good idea to get a copy of credit report from the landlord so that the tenant can know what’s being reported about you.
