Hola a todos,

Este término aparece en un cheque, dice "stale date xxxx01" y por otra parte dice "valid until xxxx02" lo cual elimina "fecha de caducación" o "fecha de vencimiento".

Gracias desde ya por sus opiniones.

No encontré exactamente "stale date" pero sí encontré "stale check" y te cito la definición:

"A check which bears a date of issue very much earlier than the date of its presentation or negotiation. A check which has been outstanding too long."

West's Law & Comm. Dic. lo traduce como "cheque vencido"

el inglés no tiene sentido. Generalmente los cheques no se acepted después de 6 meses o un año, pero algunos cheques estipulan una fecha de vencimiento de 90 días. No puede ser <stale dated> in 2001 y luego ser válido hasta 2002. Imposible. Tiene que ser un error tipográfico en inglés.

Por ejemplo, a mi me pueden dar un cheque hoy (con la fecha de hoy) y yo lo pongo en mi bolso y se me olvida depositarlo hasta 2 meses más tarde. El cheque todavía es válido pero la fecha del cheque es atrasada. La fecha se volvió añeja, como el queso ;o)

Tema complicado, pues distintos sistemas juridicos, tienen distintas reglas al respecto.

Normalmente el emisor de un cheque no puede fijar la fecha de pago, que esta determinada por la ley (por su naturaleza un cheque es "a la vista"). Pero hay regimenes donde se acepta el "cheque diferido" en los cuales se fija para el futuro la "fecha de emision" del cheque (posterior a la "fecha de libramiento"). A partir de esta fecha de "emision" futura, cuentan los plazos en los cuales el banco esta obligado a pagar el cheque (entre un mes y un año, generalmente, aunque hay regimenes en los que el cheque es valido por plazos mas largos, aunque no necesariamente como "cheque" sino como "obligacion")

El tema es complicada por la variedad de regimenes juridicos. Seria bueno ver el cheque
