Explanation:
Por ejemplo, "to strike an agreement" es alcanzar o establecer un acuerdo. Pero en este caso ya tenemos "the term", la condición o cláusula, y si "the term" ya existe, no tiene sentido que un tribunal lo establezca. Me pregunto si no habrán querido decir "... may strike off or modify the term", en cuyo caso me parece tener más sentido ya que "to strike off" significa suprimir. Así quedaría "un tribunal o arbitrador tiene/tendrá la potestad de suprimir o modificar la cláusula".

Explanation:
The two other answers offered thus far are way off the mark. To "strike" in a legal context means "to get rid of" or, in Spanish, "quitar".
