Seller shall not be considered in breach of its obligations under this contract to the extent that seller's performance is delayed or prevented directly or indirectly by any cause beyond its reasonable control, or by armed conflict, acts of terrorism, epidemics, strikes or labor disturbances, or acts or omissions of any governmental authority or the buyer or the buyer's contractors or suppliers. If an excusable event occurs, the schedule for seller's performance shall be extendedby the amount of time lost by reason of the event plus such additional time as may be needed to overcome the effect of the event.
Mi pregunta es si "excusable events" son casos de fuerza mayor o si existe otro modo de llamarlos.

Es indudable que "excusable" quiere decir "justificable", y así lo encontramos en expresiones como "excusable homicide", o "excusable neglect".
Según yo lo veo, la guerra, por ejemplo, no es "justificable", porque no es un acto de una de las partes contratantes, sino que justifica, "es justificante de" la demora o el incumplimiento de la parte.
Black's Law dice: excusable (of an illegal act or omission), not punishable under the specific circumstances.
Pero en este caso entiendo que lo que no es punible es la DEMORA o el INCUMPLIMIENTO que se genera por estos hechos... por eso propongo "justificantes".
Por otra parte, parece ser más amplio que los casos de fuerza mayor, según lo que he podido ver.

9.1.9 failure of Buyer or any of its contractors to complete Owner’s obligations hereunder in accordance with the Buyer Standards of Performance;
9.1.10 any acts or omissions by Buyer or any Person directly or indirectly engaged or instructed by it (other than Supplier or its Subcontractors or Vendors) which are not in material compliance with the requirements of this Agreement, including any task not forming part of the work to be performed by Supplier;
9.1.11 suspension or stoppages of Supplier’s obligations under this Agreement instructed by or on behalf of Buyer; or
9.1.12 Delivery of the Turbine Equipment to an Alternate Delivery Location.
9.2 Change Order for Excusable Event. If Supplier is entitled to an adjustment in the Aggregate Base Price and/or the Guaranteed Delivery Dates for any reason hereunder, then Supplier and Buyer shall execute a Change Order to effect the same.

En lo personal siempre he visto en los contratos la referencia a fuerza mayor con la frase estándar "Force Majeure", por tanto evitaría hacer referencia al término si no aparece expresamente, aunque la fuerza mayor se trate de eventos excusables o justificables, en caso de que la "rationale" del autor del texto ande por otra galaxia ;)

aunque la descripción de los eventos justificables es la clásica redacción de una cláusula de fuerza mayor. Es sólo que el término es un tanto inusual....

Cuando hablamos de un caso fortuito se considera fortuito el hecho causado por mero accidente, totalmente imprevisto, sin que medie dolo ni culpa del sujeto. Cuando algo se considera fortuito normalmente hay una exclusión de la responsabilidad. Por caso fortuito entendemos la situación no prevista, aleatoria y que no existió voluntad de alguien en su creación.
