English term or phrase: remains obstinately fit in mind and body
It is firmly established that incompetence is not a sufficient ground for removal. It is true that there are bound to be mistakes in the appointment of judges and that occassionally an appointment turns out to be a disastrous error, the more so because the judge concerned remains obstinately fit in mind and body.

Gracias
