Normalmente, es una aseveración o afirmación, pero el contexto siguiente me impide dicha traducción. Mi propuesta es: material de alegato, propuesta que no encuentro en ningún foro/ página oficial, creo que debe haber un término exacto pero no doy con él. Cualquier sugerencia futura será de gran ayuda

Creo que está claro que en este caso no estamos hablando de material como sinónimo de físico, sino de algo esencial, sustancial, etc.

Finalmente, del Black's Law Dictionary, que es la fuente principal para derecho anglosajón, me parece útil mostrarte que habla de "immaterial averment" y dice: an averment that alleges something in n eedless details, a statement that goes beyond what is is issue.
Por estos motivos es que entiendo que "material averment" se refiere a la importancia, esencialidad o carácter sustancial de una aseveración. |

Yo lo diría así con el fin de mantener el sentido original de "Averment".
Este es el sentido que precisamente recoge Alcaraz en el Diccionario de términos jurídicos en relación con "allegation".
