English term or phrase: relief sought

As there a many meanings for the word "relief" in English, I am needing the translation in Spanish that is used when an inmate (State of Nebraska, USA) is appealing the court for a lessor sentence, or for the case to be thrown out altogether for technical reasons.

Original:
"The actual predicate for the relief sought could not have been discovered earlier through the exercise of reasonable diligence."

Mi intento:
«El mismo predicado del desagravio solicitado no se pudo haber descubierto antes a través del ejercicio de una diligencia razonable».

I am using here "desagravio solicitado". Is that the right term here? Also, I would appreciate any suggestions to improve my translation should it need improving. . ..

Explanation:
"relief" es la reparación de los derechos lesionados solicitada a los tribunales o concedida por éstos, nada ver con "enmienda" (???)...
