106. Furthermore, Fox submits that there is no reason to identify different markets depending on the windows for the exploitation of content. The window system is a function of negotiation between the parties. Obviously once a film is produced it is sunk cost for the producer and, given that it can be licensed a potentially infinite number of times, the right owner is interested in creating as many licensing windows as it can. This does not mean that each licensing window constitutes a different product market. In fact, it may be the case that second windows are not used in every country or by every studio. Therefore, the relevant product market remains content rights and the window system is simply the contractual licensing mechanism used to increase the revenue stream from the product.

In this respect, it is important to notice that the market definition adopted by the SDC in the SO is narrower than the definition of the upstream market adopted by the TDC in the Sogecable / Vía Digital TDC Report. The TDC did not make a distinction between first and second window and considered the upstream market as including broadcasting rights of films produced by the Majors for both first and second windows. (See sections 5.3.1.2 and 6.2.2.1 of the Sogecable / Vía Digital TDC Report).

tras buscar en google "first window" "second window" "television rights" en una misma búsqueda, me devolvió varios resultados interesantes que verás abajo. no extraje casos concretos porque la mayoría son .pdf's, más pesados de leer para encontrar el contexto preciso.

me parece que a falta de una definición exacta, esto es a lo que se refiere, pudiendo ser 1st window cualquier cosa desde la emisión por pago o el estreno de una película, hasta la transmisión en directo de una evento deportivo. la "segunda ventana" sería los derechos de emisión en diferido, así como reestreno o reemisiones de programas ya emitidos en un mismo mercado

miraré algo más por si encuentro un término en español.
