Plainly, the rights of all accused persons must be balanced against the rights of victims, and child perpetrators require special safeguards. However, the above rights specifically concern children involved in court proceedings as victims or witnesses and, as such, are the relevant rights to be taken into account by local self-government bodies. Further efforts to articulate children’s rights, as well as those of other vulnerable groups, have also emerged through case law in the European Court of Justice. This can be seen in the case of Pupino , which considered the applicability of the EU Framework Decision on the Standing of Victims in Criminal Proceedings . The EU FD allows for minors to testify by alternative means but, at the time in question, had not been implemented in (Italian) law. The ECJ ruled domestic law is to be interpreted in the spirit of the Framework Decision on the Standing of Victims, even where it remains to be implemented. |
