Flemish to English translations [PRO] Law/Patents - Law (general) / court decision | | Flemish term or phrase: rechtsprekende op tegenspraak | | I know what this normally means but it doesn't make sense in this document. Proceedings have been stopped because of a settlement and parties are now asking for a date to have their settlement recorded officially during a hearing. In the judge's decision, she writes "rechtsprekende op tegenspraak, zeggen dat er geen aanleiding is om de partijen te horen"... since the parties are not going to be heard how can this be "after hearing both sides"? |

| | English translation:judgment after trial | Explanation: One translation given by IATE is 'judgment after trial'. If you take trial to mean an examination of the evidence (which may or may not include presentation by the parties), then the phrase still makes sense.
-> "Trial: A formal presentation of facts to a court or jury in order to reach a legal resolution."
http://url.ie/ude
-> "Trial - Law. Examination of evidence and applicable law by a competent tribunal to determine the issue of specified charges or claims."
http://url.ie/udf
So the judge seems to be saying that, after examination of the evidence (presumably including the settlement reached), there is no need to have the parties present their cases. |
