-الشطب كجزاء la radiation sanction
عندما يتما طل الخصوم في إيداع مذكراتهم منح المشرع الفرنسي القاضي إمكانية شطب الدعوى ذلك بموجب المواد 470 و 915 من قانون الإجراءات المدنية الجديد و يعتبر القرار الذي يتخذه القاضي للشطب ضمن الأعمال الإدارية و بالتالي فهو غير قابل لأي طريق من طرق الطعن. كما أن قرار الشطب يؤدى إلى سحب الخصومة من جدول المحكمة المتعلق بالقضايا السارية و لكنها تبقى ضمن الجدول العام. وإذا لم تمر مدة سنتين (مدة السقوط)، فإنه بإمكان أطراف الخصومة إرجاع القضية إلى الجدول وذلك بعد القيام بالإجراء الذي شطبت الخصومة لعدم اتخاذه (المواد 781، 90-2 من ق.إ.م.ج).
