Is verweer dat degene die prestatie eist, zelf juist eerder had moeten presteren.
Ook in Frankrijk bestaat de term exceptio (zonder n) non adimpleti contractus als synoniem van de exception (met n) d'inexécution

Dan zou ik de term gebruiken en dan toelichten 'aangezien de tegenpartij zelf niet aan zijn eerdere verplichting heeft voldaan'. Het is een specifiekere term dan wanprestatie.
