En Belgique, on définit la faillite comme une procédure d\'exécution collective s\'appliquant au commerçant qui a cessé ses paiements et dont le crédit est ébranlé; la faillite résulte du jugement déclaratif de faillite et n\'entraîne pas nécessairement la disparition de l\'entreprise, car le tribunal peut permettre la poursuite contrôlée de l\'exploitation dans le cadre du concordat après faillite.
