From the French Web sites I've consulted, "traité d'apport" seems to mean 'contribution plan' (where members make the 'apport' to a 'fonds' according to this 'traité'): L'apport des éléments incorporels et corporels d'un fonds de commerce donné en location-gérance à la société locataire gérante n'est susceptible de bénéficier du régime de faveur des fusions prévu à l'article 210 A du CGI que selon la procédure d'agrément prévue au 3 de l'article 210 B du même code. Toutefois, dans la situation où le contrat de location-gérance serait conclu pendant la période de rétroactivité, il sera considéré, en matière d'impôt sur les sociétés, que seule la date d'effet convenue entre les parties dans le traité d'apport, pourra être retenue pour apprécier le caractère complet et autonome de la branche.
