This seems to be saying that failure to acknowledge receipt within 48 hours will be deemed to constitute acceptance of the order...

Le FOURNISSEUR doit accuser réception de la commande dans un délai de 48 heures à compter de sa réception en retournant à ABC une copie de la commande revêtue de sa signature.
L’absence d’accusé de réception passé ce délai ou tout commencement d’exécution par le FOURNISSEUR sera réputé constituer une acceptation tacite de la commande.

Seems a bit illogical - the supplier is required to acknowledge receipt within 48 hours, but once 48 hours have passed, a lack of acknowledgement of receipt constitutes acceptance of the order(!) Am I reading this wrong or is it just bad drafting?

However, in this context it implies that you must check the delivery before signing and returning the acknowledgement. If after 48 hours you find there is something wrong with the delivery you cannot do anything about it: i.e. you have tacitly accepted that the delivery was in order.

Sorry, you must check that you can deliver (being the supplier) otherwise you are stuck and have to provide the goods even if it means you have to find them from another source as you have tacitly accepted the order.

The clauses are common in most contracts (sales or supply).
