"Attendu" translates as "Whereas" in legalese ... but what about when you get "Mais attendu"... ?

"Mais attendu que le marché du CD était un marché connu de M X, pour avoir géré le budget Y, qu'ainsi la reproduction des caractéristiques du marché du CD par Z est insuffisante pour caractériser un détournement d'informations stratégiques, ..."

"But whereas..." or just "But..." or something else?

In normal language it is possible for "But whereas..." to begin a sentence:
"Toast with nothing but butter is dull, and I always like to put something on it. But whereas I like jam I'm not so keen on honey."

Explanation:
"Whereas" has two quite different meanings:

"1 a: while on the contrary
b: although
2: In view of the fact that: since—used especially to introduce a [legal] preamble".

This is the second meaning: "attendu que", which as my dictionary reference shows, means "since", not "although". It's not a preamble (it says "mais attendu que"), where "whereas" would be the correct translation. So to avoid any confusion, I would say "since", not "whereas".
