I know what this means, but does anybody have a good English equivalent?
It is a question put up before a trial begins, and rather recent in French law I believe.

Hello,

All suggested answers are fine. But this seems to be some so specifically French point of law (which has been recently raised about Jacques Chirac's case) that I suggest tu just keep it in French - with of course a foot note to clearly explain what it's all about.

disagree  AllegroTrans: this is not so "unique" that it cannot be translated into English imo// certainly, the Republic of Ireland has a Supreme Court in which preliminary points concerning constitutionality can be raised, as does the USA
