C'est le constructeur qui, bien que lié à l'accédant par un contrat, ne participe pas matériellement ou intellectuellement à la réalisation de l'ouvrage car il n'est généralement un intermédiaire économique -Il dispose à ce titre d'un recours possible contre les constructeurs réalisateurs en cas de sinistre.
