Bien que la tendance actuelle dans la langue courante soit à l'emploi exclusif de l'auxiliaire avoir pour les deux sens de ce verbe, il importe de préciser que, dans l'usage soutenu, dans le style administratif et juridique, notamment dans les actes officiels et dans les conventions, l'auxiliaire être, d'un emploi plus littéraire, supplante largement l'auxiliaire avoir. « Il est convenu entre les parties contractantes que la prise d'effet du présent acte aura lieu le 1er juin 2003. » À moins que les parties n'en soient autrement convenues. S'il n'en est autrement convenu. « Il faut se rappeler que la question en litige est, comme en sont convenues les parties, de savoir si cette interprétation est juste et raisonnable. » « Le greffier s'est adressé aux jurés en ces termes : 'Mesdames et messieurs les jurés, êtes-vous convenus d'un verdict ?', et le président du jury a répondu : Oui. »
