que si les pièces du dossier ne permettent pas d’imputer de manière certaine la différence entre estimation et proposition finale à ce poste, la requérante **** n’est pas utilement contredite **** alors que le département n’établit pas que les « km haut le pied » auraient été pris en compte initialement par l’entreprise retenue ;
IN IATE I FOUND "CONTREDIT" MEANS "DISPUTE NOTE" BUT IN PROZ I FOUND IN A GLOSSARY "FORME CONTREDIT" MEANING "LODGED APPEAL". I know it has something to do with the appeal lodged by the claimant for cancellation of the award of the transport contract on the grounds that the selected company (bid winner)'s offer should have been turned down as its offer didn't comply with the contract documents since its prices were abnormally low... (The order ruled that the award of the contract be cancelled for the contested bid pacakages.) My rough translation is: If the documents of the court file don't allow to impute in a definite way to this item the difference between the estimate and the final proposal, then the APPEAL LODGED BY THE CLAIMANT ISN'T GRANTED???? (but then if the appeal isn't granted why does the order rule the cancellation of the contract award which was the motive of the appeal?)
