I am translating a manufacturing and supply contract from French to English (Canadian source). One of the standard clauses, “Portée de l’Entente”, reads as follows: “Le contrat lie les parties ainsi que leurs héritiers, successibles, mandataries […], cessionnaires, successeurs (incluant tous successeurs résultant d’une fusion), ayants droit et ayants cause respectifs”. What is the difference between “successibles” and “successeurs” in this sentence? Except for PROZ, all the bilingual and terminology sources I have consulted give “successors” for both words. One PROZ glossary gives “person entitled to inherit”, but this would be difficult to weave into this sentence (i.e., their persons entitled to inherit). Is there indeed a difference between “successibles” and “successeurs” in this sentence? Any help would be much appreciated.

Remainderman: person entitled to inherit after the usufruitier/life tenant has dropped out of the picture.

Quaere: whether successible can include a creditor of the estate. In England & Wales, a creditor can take out a grant of probate to a solvent or insolvent estate if no one else will.

heir apparent or heir presumptive


Explanation:
Heir apparent = a person whose right is indefeasible, unless he or she dies before the ancestor.
Heir presumptive = a person whose right to inherit may be annulled by the birth of a nearer heir.
"Successeur" = a successor, a person who succeeds in an office or a position, usually in a business.
