| Grading comment Jackie, thank you for your explanation that this contrasts with a best-efforts contract. In English, we usually distinguish between best-efforts and performance- guaranteed execution. Counsel's suggestion was useful, too, but for an English reader I want to preserve the "performance" concept if not the lingo.
