Your question about larger or smaller courts I think probably refers to upper and lower courts or in France the Cour d'appel and Tribunal de (Grande) Instance. From what I can surmise, it seems to be saying that the Cour d'appel is generally unsympathetic to people taking court action where a reasonable offer of settlement has been made, i.e. that if everyone took this attitude the courts would be swamped with cases, so instead of examining the basis of the case, they look at the long term effects on the judicial system.
