De plus, ces Cours insistent pour que chaque partie examine avec soin toute proposition après le début du procès, et il n'est pas rare qu'elles aient imposé des honoraires de justice et d'autres pénalités à une partie censé avoir rejeté un accord raisonnable. Des Cours plus importantes ont refusé de juger cette attitude sur le fond, apparemment intéressées à mesurer son effet à long terme. Il est donc important que la dernière offre que vous proposez (si vous n'arrivez pas à un accord) apparaisse raisonnable.

This is from a course in negotiating techniques. Various very detailed examples are given of situations that will require negotiation. Here the example is an out of court settlement. The pros and cons of settling a matter in court are presented for discussion/simulation by students.

I am not sure what they are getting at here. "Larger courts have refused to judge this attitude on its merits, apparently interested in measuring its long-term effect". My question is, what is the difference between the smaller courts and the larger courts? ("Ces cours" refers to an earlier mention of the "tribunaux locaux").
