French to English translations [PRO]
Law/Patents - Law (general) / crime, criminal record
French term or phrase: 40m avec ss 5a pour ce qui excède la détention préventive subie
Can someone help to decipher this short-hand from a Belgian criminal record transcript?

Under the field marked 'Description globale' the following is shown:

"40m avec ss 5a pour ce qui excède la détention préventive subie"

Could the first part mean '40 mois avec sursis' - if so then what does 5a refer to?

If it helps, the convictions are for possession of narcotics (on three counts), and the penalties are "emprisonnement - 40MM", "emprisonnement avec sursis - 5AA" and "confiscation".

My general guess, which I hope someone could back up, is:

"40 months with a 5 year suspended sentence for that which exceeds the custody already undergone" ... if someone can suggest a slightly better way to word this, I would very much appreciate it!

40 months, ....

Explanation:
Answers so far (including Asker's own rendering "40 months with a 5 year suspended sentence ") tend to suggest that the 40m sentence and the 5-year suspension are different penalities, which is not correct. I'd suggest:

40m avec ss 5a pour ce qui excède la détention préventive subie
-->
40 months, of which the time in excess of that (already) spent in custody is suspended for 5 years

Alternatively:
40 months, suspended for 5 years in respect of the time not already spent in custody.

Final and best answer:

40 months with a 5-year suspended sentence exceeding the time having been remanded in custody
