French to English translations [PRO] Law/Patents - Law (general) / Court brief
French term or phrase:mémoire préventif
This is the header on a legal brief submitted to a court in Switzerland. I don't find in specific term in the glossary. Would this be simply, "Preliminary Brief" or "Pre-trail brief"? or is there a specific legal term?
Explanation: It's a Swiss text so it's also virtually essential to know German too. A mémoire préventif is a Schutzschrift in German. (Easily verifiable on www).
Precautionary measure against
precautionary measures:
The protective brief
In the area of precautionary legal protection, the
new CCP does not introduce substantive innovations,
but is instead heavily founded on the existing
law. One new element, however, is the
“protective brief” (Schutzschrift), which has not
been widely used in the past and was not addressed
in the cantonal codes of civil procedure.
The protective brief is a preventive means of
defense against an expected petition for the
issuance of an interim injunction ex parte, an
attachment under the Debt Enforcement and
Bankruptcy Act, or another interim measure concerning
which the respondent is for once not heard
in advance. This is conceivable if the petitioner can
credibly rely on particular urgency. The protective
brief gives the respondent a means for presenting
his position in advance all the same.
...
The anticipatory brief is valid for six months from
its submission; after that time, it may no longer
be considered by the court. It is sent to the opposing
party only if and when that party institutes a
corresponding proceeding. http://www.wenger-plattner.ch/files/downloads/files/5377e54f...

There are very precise explanations of what is involved. Just looking in the Kudoz glossary isn't very likely to help with such terms. They have to be researched.

Explanation: This assumes either civil or criminal and for use in either the UK - or the USA where the asker is from.
In the UK and Australia, for instance, pre-action protocols state the routine and time frames for conducting civil proceedings.
Example sentence(s):

Note to reference poster
Asker: Thanks for the references. I did see one of these, and I understand WHAT it is, and how it seems to apply from a legal standpoint. But what I don't find is a good translation of the term into English legalese. Does "pre-trial brief" make more sense than, say, ""preventive brief"

Could this even be qualified as a "pre-rial motion"?
