neutral  AllegroTrans: assertion yes, but I think "mere" is stretching it - maybe it was substantiated; "simple" does not appear in the French text

  -> If the quote is from the Defendants - unspecified by the asker- then the labelling as an assertion or averment is meant sardonically. Googling the phrase throws up this irony of 'mere' puff.
