aleatory contract Explanation: aleatory contract A contract whose value to either or both of the parties depends on chance or future events, or where the monetary values of the parties' performance are unequal. An insurance policy is an aleatory contract because the insurer's obligation to pay a loss depends on uncertain events, while the insured must pay a fixed premium during the policy period. (http://www.nils.com/rupps/aleatory-contract.htm) ALEATORY CONTRACT - A contract in which the number of dollars to be given up by each party is not equal. Insurance contracts are of this type, as the policyholder pays a premium and may collect nothing from the insurer or may collect a great deal more than the amount of the premium if a loss occurs. aleatory contract Explanation: Yes. An aleatory contract is one in which a party's duty of performance depends upon some uncertain event : Ellesmere v Wallace [1929] 2 CH 1 (in this case it was a wagering contract, not exactly the same context). DALLOZ. (The bible for law students, at least first & second year here and in Aix-en-Provence). No doubt in my mind that the terms mean the same thing. Go for it! Nikki Lex. de termes juridiques, DALLOZ Dic of Law, Curzon, Financial Times Publishing |
