Je ne vois pas concrétement ce qui se passe :
Pour moi waiver, cela veut dire soit être exempté/déroger à l'application
d'une clause, soit y renoncer.
Je n'arrive pas à saisir l'association : waiver of a breach.

Un exemple concret, une explication, voire une traduction qui m'aiderait ?

Si l'un des parties venait à défaillir aux termes du contrat, mais que l'autre partie ne réagissait pas (dérogeant ainsi à son droit de poursuivre en justice), ceci ne voudrait pas forcément dire qu'il en serait ainsi si la même chose se reproduisait par la suite...
