French term or phrase:fixation
The word "fixation" occurs on a couple of occasions in the "exclusive recording contract" I am translating.
First I thought I'd translate it as "reproduction" (based on previous proz entry), but then it occured in a list with "réproduction", so I though maybe "recording" would work, but now I have this sentence which makes me want to find a separate word for "fixation":
"En conséquence, l'ARTISTE ne pourra, à quelque titre que ce soit, ni autoriser, ni permettre dans les termes prévus à l'article 1 ci avant, la fixation, la reproduction, l'exploitation et la diffusion, par un tiers aux présentes, d’enregistrements de ses interprétations et/ou exécutions quelle qu'en soit la nature ou la destination, avant l'expiration de la période d'exclusivité sus-définie."
Another example: "il est rappelé que Societé A (l'éditeur) est pendant la durée contractuelle titulaire du droit exclusif de fixation, de reproduction, de mise à disposition et de communication au public par tous moyens des interprétations et/ou exécutions par l'ARTISTE de toutes oeuvres musicales..."
Explanation: i.e. fixing in a material form, for example writing something down or committing to a physical container (i.e. tape in the case of a recording).

Fixation in law refers to works entitled to copyright protection (e.g. music, literature, paintings, etc.). Only works fixed in a medium can be copyrighted, not the ideas behind those works.
I think you're right, that's what it means here alright; I just don't know if there is any more modern term used in the industry, given the new techniques used these days for storing data... ???

Asker: I am coming around to this after a bit more googling things like "audio visual fixation" and "fixation of recording". I had previosuly dismissed it after looking at definitions in dictionaries, but I think in this context it may be right.
