I know that Par dérogation means notwithstanding, but I don't really understand how expresse fits in here, because as far as I know you can't "expressly notwithstand" something :) I would love some help.

Actually 'Notwithstanding" would be perfect here, and shorter than "by express derogation". "Express" is unnecessary - after all, the fact that it's written down makes it express.
It still means "notwithstanding" - but expressly so.
