Hi: This term appears in the "Propriete/Jouissance" section of the Compromis de vente I'm translating for a course I'm taking. Here's the context: "A defaut de reiteration par acte authentique, un proces verbal de carence sera dresse a la requete de la partie la plus diligent........" What I've come up with so far is "record of insolvency" or "record of incompetence", but both of those don't feel quite right. Thanks in advance for your help.

BUT, in rereading the sentence, I just realized that the meaning is given by the first part:

A defaut de reiteration par acte authentique....the carence thereof,
the lack of something that comes before; there must be something in the previous sentence. Or it means waiting period...IMO

Unless stipulated in an instrument drawn up by a notary public, a record of that there is a waiting period shall be drawn up at the request

good luck...Hope you see the process I used to find a possible answer. Your context should tell you if waiting period works OR if there is some other antecedent sentence that provides a better clue...
