But here it seems also a meaning of " unique , sui generis " special in kind |

This is another of those turns of phase peculiar to patentese -- in this case, shorthand for "...existing in the prior art (that is, in similar inventions that have already been patented and that may have entered the public domain) and familiar to (another catch-phrase coming up) those skilled in the art."
