Für "rupture conventionnelle hätte ich "einvernehmliche Kündigung" genommen. Was ist dann aber die "rupture négociée? Wenn sie ausgehandelt wird, ist sie ja auch irgendwie einvernehmlich???

La rupture conventionnelle se matérialise par la signature d'une convention entre l'employeur et le salarié qui est homologuée par le directeur départemental du travail ou autorisée par l'inspecteur du travail pour les salariés protégés.

La rupture conventionnelle homologuée ne peut pas être employée dans le cadre d'accords collectifs de gestion prévisionnelle des emplois et des compétences et de plans de sauvegarde de l'emploi.

Il est néanmoins toujours possible de convenir de *départs / ruptures négocié(e)s* dans ces situations, indépendamment de la procédure de *rupture conventionnelle*.
