Le code civil précise que la vente est définitive entre les parties dès que le bien vendu est déterminé et dès que le prix est fixé, même si ce bien n'a pas été délivré ou si le prix n'a pas été payé (Article 1583). Dès que les parties signent un engagement réciproque, chacun est définitivement engagé. Le vendeur ne pourra plus vendre à quelqu'un d'autre qui lui offrirait un prix plus élevé, et l'acquéreur ne peut plus se désister Pour éviter toute discussion ultérieure, le compromis devra donc être rédigé avec le plus grand soin et la plus grande clarté.
