Kann mir jemand sagen, was genau dieses "jouer" hier bedeutet? Die Änderung des Baupreisindex wird automatisch berücksichtigt/gültig/übernommen..., oder doch etwas anderes? Was meint ihr? |

"jouer" hier salopp im Sinne von funktioniert, wirkt sich aus.
Es handelt sich um eine Wertsicherungsklausel / Gleitklausel, die in D (anders als in F) bei *Wohnraum*mietverträgen genehmigungspflichtig wäre: Soll die Miete sich bei Veränderungen des Index automatisch, d.h. ohne dass die Miete neu verhandelt oder festgesetzt wird, verändern, bedarf die Vertragsklausel der Genehmigung des Bundesamts für Wirtschaft und Ausfuhrkontrolle (www.bafa.de).

Im Beispielsatz heißt es noch "Mietzins". Der deutsche Gesetzgeber hat seine Terminologie aber vor einigen Jahren dem allgemeinen Sprachgebrauch angepasst und spricht seitdem nur noch von Miete. Miete bezeichnet also nicht nur die Art des Vertrages sondern auch das Entgelt.
Indexmiete für Wohnraum in Deutschland: siehe 557b Abs. 3 BGB: Änderung wird erst wirksam, wenn der Vermieter sie dem Mieter mitgeteilt hat. |
