Il faut un élément matériel. Il existe plusieurs types de cas.
Ainsi, par exemple, ce peut être aussi la soustraction de la succession en effectuant des retraits de sommes d’un compte bancaire (CA Paris, 2 décembre 1987). Quindi il recel può anche prevedere i due casi se tenta di appropriarsi di un bene o se l'ha già preso.
