GLI ERANO STATI offerti 30 euro come risarcimento relativo a prodotti Microsoft che non voleva, ricevuti “in bundle” con il suo notebook, ma non si è accontentato e ha trascinato Acer in tribunale.
Il francese Antoine Gutzwiller ha ottenuto il risarcimento per un nutrito elenco di software indesiderato che ha trovato in bundle nel pc portatile che aveva acquistato; non soltanto, gli è anche stato riconosciuto un extra di 500 euro per **resistenza abusiva** da parte di Acer.
Nel suo blog qui, Gutzwiller fa notare che il notebook era stato acquistato per la somma di 599 euro, quindi il risarcimento ottenuto, relativamente al software, ammonta a una cifra pari circa al 50% del prezzo del prodotto.

Probabilmente è perché non esiste una norma corrispondente del codice civile italiano. Non perso che sia un francesismo, ma solo una traduzione letterale in mancanza di meglio. Penso che potresti tradurre: "ritardo abusivo di pagamento".

Asker: Ti ringrazio della risposta. L'avevo trovata anch'io, ma ho paura che si tratti di un francesismo perché non riesco a trovare nessun riscontro giuridico che corrisponda alla fattispecie francese.
